Out Market Them provides digital marketing services including local SEO, paid advertising management (Google Ads, Meta Ads), and website design and development for local service businesses. The specific scope of services for each client is defined in a separate Service Agreement or Statement of Work agreed upon prior to engagement.
3. No Guarantee of Results
While we have a strong track record of delivering results for our clients, digital marketing outcomes can be affected by factors outside our control including market conditions, search engine algorithm changes, competitor activity, and client responsiveness. We do not guarantee specific revenue, lead volume, or ranking outcomes. All case studies and metrics shared on our website reflect real client results but are not guarantees of future performance.
4. Payment Terms
Service fees are billed monthly in advance unless otherwise agreed in writing. Invoices are due within 7 days of issue. We reserve the right to pause or terminate services for accounts with overdue balances exceeding 14 days. All fees are non-refundable unless expressly stated in your Service Agreement.
5. Intellectual Property
Upon full payment of all outstanding fees, clients own the deliverables created specifically for them (website designs, written content, ad creative). Out Market Them retains ownership of proprietary methodologies, systems, frameworks, and tools used to deliver services. We reserve the right to reference client work in our portfolio and marketing materials unless a client requests otherwise in writing.
6. Client Responsibilities
Clients agree to provide timely access to required platforms, accounts, and information necessary for service delivery. Delays caused by client non-responsiveness may affect timelines and do not constitute a failure of service on our part.
7. Termination
Either party may terminate services with 30 days written notice. We reserve the right to terminate services immediately for cause, including non-payment, abusive conduct, or requests to engage in practices that violate platform policies or applicable law. In the event of termination, clients are responsible for all fees accrued up to the termination date.
8. Limitation of Liability
To the maximum extent permitted by law, Out Market Them shall not be liable for any indirect, incidental, special, or consequential damages arising from our services or your use of our website. Our total liability in connection with any claim shall not exceed the total fees paid by you in the 3 months preceding the claim.
9. Website Use
You may use our website for lawful purposes only. You must not misuse our website by knowingly introducing malicious software, attempting to gain unauthorised access to systems, or engaging in any conduct that disrupts other users. We reserve the right to restrict access to our website at our discretion.
10. Governing Law
These Terms are governed by the laws of the United States and the State of Arizona. Any disputes arising from these Terms or our services will be resolved through good faith negotiation, and if necessary, binding arbitration in accordance with the rules of the American Arbitration Association.

We may update these Terms from time to time. We will notify active clients of material changes. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
